Terms of Service

Welcome to Aviosa.fun ("Aviosa", "we", "us"). These Terms of Service ("Terms") govern your access to and use of our platform and services ("Service"). By accessing our Service, you agree to these Terms and our Privacy Policy.

1. Eligibility Requirements

You must be at least 13 years old to use our Service. Residents of the European Economic Area (EEA) or United Kingdom must be at least 16 years old. If local laws require higher minimum ages, those requirements apply.

We provide an optional feature referred to as "Spicy Mode", which enables AI bots to engage in discussions that may include mature or adult-oriented topics. Access to this feature is restricted to users who are 18 years of age or older. When this feature is disabled, our systems implement active content filtering to restrict exposure to sensitive material.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately of any unauthorized access or security breaches.

3. User Content & Licensing

You retain full ownership of all content you create and submit (“User Content”). By submitting User Content, you grant Aviosa a limited, non-exclusive, royalty-free, worldwide license solely to operate, maintain, and improve the Service. This license automatically ends when you delete your content or your account (see Privacy Policy section 8). This license does not grant Aviosa any rights to sell, distribute, or publicly display your content outside the scope of the Service.

We care about your privacy: Your User Content is treated with strict confidentiality and is never used to train AI models or shared with third parties for marketing or profiling purposes. We only use it to provide, operate, and deliver the service.

4. Content Standards

By using Aviosa, you agree not to publish, post, or otherwise make available on the platform any content that:

• Constitutes hate speech, harassment, discrimination, or threats against any individual or group;
• Involves spam, deceptive practices, fraudulent schemes, or impersonation of any person or entity;
• Promotes illegal activities or infringes upon the intellectual property or other proprietary rights of any third party;
• Contains defamatory, obscene, or otherwise offensive material, or content intended to shock, humiliate, or disgust;
• Violates the privacy rights or misuses the personal data of any individual;
• Encourages, promotes, or depicts self-harm, suicide, or other acts that may result in serious physical harm;
• Contains sexually explicit material, nudity, or pornography;
• Exploits, abuses, or sexualizes minors in any manner;
• Uses Aviosa to solicit, facilitate, or engage in unlawful transactions, including but not limited to the sale of illegal goods or services.

4.1 Character Definitions & Ownership

• All character profiles, backstories, images, and related assets (“Characters”) are created, owned, and controlled by the user who submitted them.
• By publishing a Character as “public,” you grant us a limited, non-exclusive, royalty-free, worldwide license solely to use, display, and distribute that Character content as necessary to operate and provide the service.
• This license does not grant us any rights to use the Characters for AI model training, marketing, promotion, or any commercial purposes beyond operating the service.
• Private Characters remain visible only to you and are not used by us outside the scope of providing and operating the service.

4.2 AI-generated Avatars

Our Service includes an image generation feature that allows users to create avatars or images for their Characters or Personas. When you use this feature:

• You are solely responsible for the prompts you submit and content you generate.
• You agree not to generate images that violate the Content Standards in Section 4.
• Subject to third-party rights, you retain ownership of AI-generated images you create. By generating an image, you grant Aviosa a limited, non-exclusive, royalty-free, worldwide license to use, store, and display that image as necessary to provide the Service.
• Aviosa does not claim ownership of your generated images and does not use them to train AI models.
• Aviosa is not liable for any claims relating to AI-generated content, including but not limited to intellectual property disputes, offensive or harmful material, or misuse by others.

5. Moderation & Termination

To keep our community safe and respectful, we may:

• Review and remove content that breaks these terms or is otherwise harmful to the community;
• Disable or delete accounts that violate these Terms or misuse the service;
• Take action such as warnings, temporary suspensions, or permanent bans when needed;
• Use automated tools and/or human moderators to help with these decisions;

Aviosa will not be kept responsible for any loss caused by moderation or account actions.

If you believe a moderation action was taken in error, you may contact us at support@aviosa.fun to request a review. While we reserve final discretion, we aim to be fair and transparent in all moderation decisions.

6. Subscription Services & Payments

6.1 Subscription Plans

Aviosa offers an optional subscription plan that provides access to premium features for 1.99 USD per month (or as otherwise stated). Subscription availability, features, and pricing may be modified, paused, or discontinued at any time. Whenever practicable, we will provide reasonable notice of significant changes.

6.2 Billing & Payment

• Subscriptions automatically renew each billing cycle unless cancelled before the renewal date. You may manage or cancel your subscription at any time through your account settings.
• All payments are processed securely by independent third-party payment providers. By subscribing, you agree to their terms and conditions. While Aviosa selects reputable partners, we are not responsible for their actions, system errors, or service interruptions.
• By subscribing, you authorize the applicable payment processor to charge your selected payment method. Aviosa is not liable for failed or delayed payments caused by the payment processor or your financial institution.
• As premium features are made available immediately upon payment, all subscription payments are non-refundable, except where required by applicable law.
• You are responsible for any taxes, duties, or government charges applicable to your subscription. Prices may exclude VAT, sales tax, or other similar charges unless otherwise stated.

6.3 Cancellation

You may cancel your subscription at any time through your account settings. The cancellation will take effect at the end of your current billing period. While partial refunds are not provided, you will retain access to premium features for the remainder of the period already paid. Refunds are issued only when required by law.

6.4 Service Changes

Aviosa may update, modify, suspend, or discontinue any subscription feature at its discretion. We will make reasonable efforts to notify affected users in advance, when possible. While we do not provide compensation for such changes, our goal is to continuously enhance your experience and maintain transparency.

6.5 EU/EEA/UK Consumer Rights & Refunds

For users residing in the EU, EEA, or UK: You may have a legal right to withdraw from a subscription within 14 days of purchase, provided the digital content has not been fully delivered or accessed. By choosing to access premium features immediately, you expressly agree to waive this withdrawal right. Aviosa complies with all applicable consumer protection laws but does not extend refunds beyond what is legally required.

If you experience technical difficulties accessing paid features, please contact us at support@aviosa.fun. We will make every reasonable effort to assist, though refunds or compensation are limited to what is required by law.

6.6 Payment Processors

Payments are processed by PayPal or other trusted third-party providers. Aviosa does not store your full payment information and is not responsible for any errors, disputes, or fraudulent activity occurring through those providers. Please review the applicable terms and privacy policies of your chosen payment processor for further details.

7. Third-Party Services

To provide our service, Aviosa integrates with the following external platforms:

• DeepInfra – Provides AI-powered chat responses, image generation, and data processing.
• ImageKit – Handles media storage and delivery (such as profile pictures, character/persona avatars, etc.).
• Umami – Provides privacy-focused website analytics without using cookies or collecting personally identifiable information.
• PayPal – Handles payment processing and related financial transactions.
• Cloudflare Turnstile – Provides bot detection and CAPTCHA functionality; processes minimal data such as IP address & browser information.

Important: These services operate under their own terms and privacy policies. While we actively vet partners for compliance, we cannot control their systems. By using Aviosa, you acknowledge that:

• Service disruptions or changes by these providers may temporarily affect functionality.
• We share only the minimal data required for operation (e.g., prompts sent to DeepInfra for AI-generated responses).
• No third party has permission to retain your data beyond service delivery needs.

Note: We regularly audit third-party partners to ensure alignment with our Privacy Policy standards.

8. Intellectual Property

All code, designs, and branding of the Aviosa platform are protected intellectual property. No content or functionality may be copied, modified, or distributed without express written permission.

9. Policy Changes

We may make minor updates (such as correcting typos or clarifying language) without notice. Material changes that affect your rights will be announced at least 7 days before the effective date of material changes via:

• In-site notifications
• Updated effective dates on this page

Continued use constitutes acceptance of revised terms.

10. Limitation of Liability

The Service is provided on an “as-is” and “as-available” basis. Aviosa.fun and its owners, operators, and representatives make no warranties, guarantees, or promises regarding the Service, including but not limited to uptime, accuracy, security, or results of AI-generated content.

To the maximum extent permitted by applicable law, Aviosa.fun and its owners, operators, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service—even if we have been advised of the possibility of such damages.

Where local law prevents full exclusion of liability, our liability will be limited to the minimum amount required by law.

11. Governing Law

These Terms are governed by Romanian law, excluding conflict of law principles.
